Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

  • Withdrawal Period: The period during which the consumer can exercise their right of withdrawal.

  • Consumer: A natural person who is not acting for purposes related to their trade, business, or profession and who enters into a distance contract with the trader.

  • Day: Calendar day.

  • Long-Term Transaction: A distance contract relating to a series of products or services, where delivery and/or purchase obligations are spread over time.

  • Durable Medium: Any tool that enables the consumer or trader to store information addressed personally to them in a way that allows future access and unchanged reproduction.

  • Right of Withdrawal: The possibility for the consumer to withdraw from the distance contract within the withdrawal period.

  • Trader: A natural or legal person who offers products and/or services to consumers remotely.

  • Distance Contract: A contract concluded between a trader and a consumer within an organized system for distance selling, using one or more means of remote communication.

  • Means of Distance Communication: Any method used to conclude a contract without the consumer and trader being physically present together.

  • Terms & Conditions: These general terms and conditions of the trader.

Article 3 – Applicability

These Terms & Conditions apply to every offer made by the trader and to every distance contract concluded between the trader and the consumer.

Before concluding a distance contract, the text of these Terms & Conditions will be made available to the consumer. If this is not reasonably possible, the trader will indicate where they can be accessed and that they will be provided free of charge upon request.

If the contract is concluded electronically, these Terms & Conditions may be provided in a way that allows them to be stored on a durable medium. If not, the trader will indicate where they can be viewed electronically and that they will be sent free of charge upon request.

If specific product or service conditions apply, the same principles apply. In case of conflict, the consumer may rely on the provision most favorable to them.

If any provision is invalid, the remaining provisions remain in force. The invalid provision will be replaced by one that most closely reflects the original intent.

Situations not covered or unclear interpretations will be assessed in the spirit of these Terms & Conditions.

Article 4 – The Offer

If an offer has a limited validity period or conditions, this will be clearly stated.

All offers are non-binding. The trader reserves the right to modify or withdraw offers.

The offer includes a complete and accurate description of products and/or services. Images are a true representation, but obvious errors are not binding.

All images, specifications, and data are indicative and cannot lead to compensation or contract termination. Colors displayed may differ from actual product colors.

Each offer clearly states:

  • Prices including taxes

  • Delivery costs (if applicable)

  • Contract formation process

  • Whether the right of withdrawal applies

  • Payment, delivery, and execution methods

  • Validity period of the offer

  • Communication costs (if applicable)

  • Whether the contract is archived

  • Ability to review and correct data

  • Applicable codes of conduct

  • Minimum contract duration (if applicable)

Optional: available sizes, colors, and materials.

Article 5 – The Contract

The contract is concluded once the consumer accepts the offer and meets the conditions.

If accepted electronically, the trader will confirm receipt immediately. Until confirmation is received, the consumer may cancel.

The trader ensures secure data transfer and payment processing.

The trader may verify the consumer’s ability to meet payment obligations. Orders may be refused or subject to conditions.

The trader will provide:

  • Complaint address

  • Withdrawal information

  • Warranty details

  • Additional contract information

  • Termination conditions for long-term contracts

Contracts are subject to product availability.

Article 6 – Right of Withdrawal

Consumers may withdraw from a purchase within 14 days without reason.

The withdrawal period starts the day after delivery.

Products must be handled carefully and only used to assess them. Returns must include all accessories and original packaging.

Consumers must notify the trader within 14 days and return the product within 14 days after notification.

Failure to do so makes the purchase binding.

Article 7 – Costs of Withdrawal

The consumer bears return shipping costs.

Payments will be refunded within 14 days after withdrawal, provided the product is returned or proof of return is provided.

Article 8 – Exclusion of Withdrawal

Withdrawal may be excluded for:

  • Custom-made products

  • Personal items

  • Perishable goods

  • Market-dependent products

  • Newspapers or magazines

  • Opened software/audio/video

  • Hygienic products with broken seals

And for services such as:

  • Accommodation, transport, or leisure services on specific dates

  • Services started with consent

  • Gambling or lottery services

Article 9 – Pricing

Prices will not increase during the offer period, except for legal changes.

Market-dependent products may have variable pricing.

Price increases within 3 months are only allowed if legally required. After 3 months, consumers may terminate the contract.

All prices include VAT.

Article 10 – Conformity and Warranty

Products comply with the contract and legal requirements.

Manufacturer warranties do not affect consumer rights.

Defects must be reported within 14 days.

Warranty is void if:

  • Products are modified

  • Misused

  • Damaged by external factors

Article 11 – Delivery and Execution

Orders are handled with care.

Delivery is made to the provided address.

Orders are fulfilled within 30 days unless agreed otherwise.

If delivery fails, the consumer may cancel and receive a refund.

Risk transfers upon delivery.

Article 12 – Long-Term Contracts

Consumers may cancel:

  • Anytime for indefinite contracts (1 month notice)

  • At the end of fixed contracts (1 month notice)

Renewals are limited and regulated.

Article 13 – Payment

Payments must be made within 7 working days unless otherwise agreed.

Errors in payment details must be reported immediately.

Recovery costs may apply in case of non-payment.

Article 14 – Complaints Procedure

Complaints must be submitted within 7 days.

They will be handled within 14 days.

If unresolved, disputes may be escalated.

Valid complaints may result in replacement or repair.

Article 15 – Disputes

All agreements are governed by Dutch law, even if the consumer resides abroad.
